looks more convincing in plain English than in law, I suspect. That said, anything is possible in a judicial review process.
It's a long shot, but an interesting one.
ReplyDeleteEven if it succeeds, I suspect the Government will be sent back to give 'due regard' before taking the same decisions over again. But with judicial review, a lot comes down to whether the judge had a god egg for breakfast that morning.
